Providing farm information for mapping

You are required to provide us with all information that we reasonably request from you about your farm in relation to our mapping service. This could include but is not limited to the farm area, location, boundaries, location of services and hazards on the farm. It is your responsibility to ensure that the information that you provide is complete, accurate and correct. We will rely on the information provided by as being complete, accurate and correct. Our service does not include investigation of the completeness, accuracy or correctness of the information provided by you or our own investigations about your farm.

We do not accept any liability for:

• any consequences arising as a direct or indirect result of you providing incomplete, inaccurate and/or incorrect information, and us using such information in providing our service;

• any person or entity’s use of, or reliance on, your map. Any additional work that is required as a result of you supplying us with incomplete, inaccurate and/or incorrect information will incur additional costs for you. We will notify you if this occurs.

Use of third party mapping systems:

We may use, at our sole discretion, third party mapping software or services as part of our service. When using any third party software or service as part of our service, we are relying on the third party to ensure that the information and documentation that they provide to us is as accurate as is reasonably practicable. You accept that: • there could be errors, omissions or other inaccuracies that occur with your map as a result of a third party service provider; and • we are not liable for any such errors, omissions or other inaccuracies. Our use of any third party service provider does not include us: • investigating or verifying the completeness, accuracy or correctness of the information presented or provided by the third party service provider; • ensuring that the information provided by the third party service provider about your farm is identical to the information provided by you about your farm. Once we have produced an electronic proof of your farm map, you will be required to review the map and confirm that it accurately and fully represents your farm and all of the mapping features that form part of our service for your farm. If there are any inconsistencies or errors with the farm information it is your responsibility to notify us of those at this stage. Once the proof of your farm is confirmed by you and sent by us for printing, we accept no liability for any inconsistencies or errors with the farm information set out on your map.

Use of third party printing service

We may, at our sole discretion, use a third party printing service to print your map. You acknowledge and accept that your map may have minor differences from the proof confirmed by you, such as colour changes and font sizing. We will not check the final map before it is sent by the printer to you. It is your responsibility to notify us if the map that you receive differs materially from the proof that you confirmed. If you do not notify us in writing within 15 working days of receipt of your map from the printer, you are deemed to have approved the map. In that case, to the maximum extent permissible by law, we do not accept any liability for: • your map differing materially from the proof due to the actions or omissions of the printing service; • any consequences that arise directly or indirectly as a result of your map differing materially from the proof due to the actions or omissions of the printing service.

Use of other contractors/services:

We may, at our sole discretion, use other services including but not limited to qualified land surveyors and graphic designers during our service to you. When using these services, we are relying on: • the service providers following their own industry ‘best practice’ guidelines and regulations; and • their representations of their training, qualifications and expertise. To the maximum extent permissible by law, we do not accept any liability for the work undertaken by these service providers/contractors and any direct or indirect consequences of their work being inaccurate or incorrect. You accept that: • there could be errors, omissions or other inaccuracies that occur with your map as a result of a third party service provider; and • we are not liable for any such errors, omissions or other inaccuracies.

Shipping:

Your map will be couriered directly to you using a third party courier. You must ensure that the packaging is not damaged before accepting the delivery from the courier. If your courier package is damaged on arrival, you must notify us immediately and must not open the package or accept delivery from the courier. To the maximum extent permissible by law, we do not accept any liability for damage to your map if you: • fail to notify us immediately of a damaged package; and/or • accept a damaged package from the courier; and/or • open a damaged package.
